This applies to the base spell level of the spell prior to any metamagic being applied to it (though spells which have been researched to always include one or more metamagics have a higher base spell level).
The rod's ability can also be applied to any spell-like ability that the wielder possessed at character level 18 or earlier, assuming that ability meets the requirements described above.
This magic item does not require an attunement period, and grants its benefits immediately upon being worn or wielded.
